1. Introduction Welcome to Pure Côte d’Azur (www.purecotedazur.com). These Terms and Conditions govern your use of our website and the luxury concierge, travel, and lifestyle services provided by Sunshine World trading as Pure Côte d’Azur (“we,” “us,” or “our”). By accessing our website or booking our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
2. Our Services and Role Pure Côte d’Azur acts as a premium luxury concierge and booking agent. We facilitate the arrangement of tailored holidays, private yacht charters, private jet charters, luxury vehicle rentals, villa accommodations, and other bespoke experiences on the French Riviera.
- When booking third-party services (e.g., yachts, jets, cars, villas), we act solely as an agent on behalf of the underlying supplier or operator.
- Your contract for the provision of these specific services will be directly with the supplier, and their specific terms and conditions will also apply to your booking.
3. Bookings, Payments, and Deposits
- Quotes and Availability: All quotes provided are subject to availability and are not guaranteed until a formal booking confirmation is issued and the required deposit is received.
- Deposits: A non-refundable deposit is required to secure any booking. The specific deposit amount varies depending on the service (e.g., yacht charters may require a standard Advance Provisioning Allowance (APA) in addition to the charter fee).
- Final Payment: The balance of your booking must be paid in full by the date specified in your booking confirmation invoice. Failure to pay the balance on time may result in the cancellation of your booking and the forfeiture of your deposit.
- Payment Methods: We accept major credit cards and bank wire transfers. Additional processing fees may apply depending on the payment method chosen.
4. Cancellations and Amendments
- Cancellation by You: All cancellation requests must be submitted in writing. Because we secure high-demand, exclusive assets on your behalf, cancellation policies are strictly enforced. The cancellation fees will be outlined in your specific booking agreement and will reflect the terms of the third-party suppliers involved.
- Amendments by You: If you wish to change your itinerary or booking details, we will make every effort to accommodate your requests. However, changes are subject to availability and may incur additional administrative fees or increased costs from suppliers.
- Cancellation by Suppliers: In the rare event that a supplier must cancel or significantly alter a booked service (e.g., due to mechanical failure of a yacht or jet), we will use our best endeavors to source a suitable, equivalent alternative. If an alternative cannot be found, a refund will be processed in accordance with the supplier’s terms.
5. Client Responsibilities
- Travel Documentation: It is the responsibility of the lead passenger to ensure that all members of their party possess valid passports, visas, and any required health documentation for travel to France and the European Union.
- Behavior and Compliance: You and your guests must comply with the rules and regulations of all third-party suppliers. This includes, but is not limited to, the authority of the yacht captain, the pilot in command of an aircraft, and the terms of luxury vehicle rental agreements. Suppliers reserve the right to terminate a service without refund if a client’s behavior is deemed unsafe, disruptive, or illegal.
- Security Deposits (Franchise): Services such as luxury vehicle rentals and villa stays typically require a substantial security deposit held on a major credit card. You are responsible for ensuring sufficient funds are available for these holds.
6. Insurance We strongly advise all clients to purchase comprehensive travel and lifestyle insurance at the time of booking. This insurance should cover, at a minimum, trip cancellation, medical emergencies, repatriation, loss of luggage, and personal liability. Pure Côte d’Azur is not liable for any costs incurred due to your failure to secure adequate insurance.
7. Force Majeure We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond our reasonable control. Such causes include, but are not limited to: severe weather conditions, natural disasters, acts of God, war, terrorism, civil unrest, strikes, pandemics, or governmental action.
8. Limitation of Liability
- To the fullest extent permitted by law, Pure Côte d’Azur shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services or the services provided by our third-party suppliers.
- Our maximum liability to you, if any, shall be limited to the total amount paid by you to us for the specific service in question.
- We do not accept liability for any injury, illness, death, loss, damage, expense, cost, or other sum or claim of any description whatsoever which results from the fault of the person(s) affected or any member(s) of their party.
9. Intellectual Property and Website Use All content on www.purecotedazur.com, including text, graphics, logos, images, and software, is the property of Sunshine World or its content suppliers and is protected by international copyright laws. You may not reproduce, duplicate, copy, sell, or otherwise exploit our website or any portion of it for any commercial purpose without express written consent.
10. Governing Law and Jurisdiction These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Sunshine World is registered- either France or the USA depending on the specifics of the contract. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the respective courts.
